BrightBox — Terms of Use (EULA)
Effective date: November 9, 2025
These Terms of Use (“Terms”) are a legal agreement between you (“you,” a parent or legal guardian) and Zionyx Studios LLC (“BrightBox,” “we,” “us,” or “our”). By downloading or using BrightBox, you agree to these Terms. If you do not agree, do not use BrightBox.
Important: BrightBox is designed for families and should be used under a parent or guardian’s supervision. Purchases and external links are protected behind an app-specific parental passcode created in the app (not device biometrics or the device passcode).
1) Who May Use BrightBox
BrightBox provides early-learning content intended for children ages 3–12 under supervision.
Only a parent or legal guardian may configure the Parents area, create or change the parental passcode, manage subscriptions, or contact support.
2) License & Ownership
We grant you a limited, non-exclusive, non-transferable, revocable license to use BrightBox for your personal, non-commercial use on Apple-authorized devices you own or control.
BrightBox and its content are owned by Zionyx Studios LLC or our licensors and are protected by intellectual-property laws. All rights not expressly granted are reserved.
3) Subscriptions, Free Trials & Billing (Apple)
BrightBox offers auto-renewing subscriptions that unlock additional features.
Title & Length: Subscription titles and durations (e.g., Monthly) are shown in the app.
Price: Prices are shown in-app and may vary by region; taxes may apply.
Payment: Your Apple ID is charged by Apple at the time of purchase.
Auto-Renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
Manage or Cancel: Go to Settings → [Your Name] → Subscriptions on your device to manage, switch plans, or cancel.
Renewal Charges: Your Apple ID may be charged within 24 hours prior to the end of the current period for the next term.
Free Trials/Intro Offers: If offered, trials convert to a paid plan at the end of the trial unless canceled at least 24 hours beforehand (one trial per Apple ID where applicable).
Refunds: Billing and refunds are handled by Apple. Contact Apple Support for refund requests.
Restore Purchases: Use Parents → Restore Purchases within the app.
4) Parental Passcode & Safety
The Parents area (including purchases, external links, and settings) is protected by an app-specific parental passcode you create in the app.
Do not share the passcode with children. You are responsible for actions taken within the Parents area and for supervising your child’s use.
5) Privacy
Your use of BrightBox is also governed by our Privacy Policy (linked in-app and on our website), which explains what information we handle and how.
No third-party ads or third-party tracking in the kids experience.
Voice/AI features (if enabled by a parent) may process short text snippets solely to return a response—not for advertising.
6) Acceptable Use
You agree not to:
Attempt to bypass the parental passcode or safety measures;
Reverse engineer, modify, or distribute the app or its assets;
Use BrightBox to collect personal information from children;
Upload unlawful, harmful, or infringing content;
Interfere with or disrupt the app or our services.
We may suspend or terminate access for violations of these Terms.
7) Service Availability & Changes
We may update, suspend, or discontinue features, content, or plans at any time (for example, to improve safety or comply with law). If we materially change these Terms, we’ll update the “Effective date” and, where required, notify you in-app or on our website.
8) Disclaimers
BrightBox is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
9) Limitation of Liability
To the maximum extent permitted by law, Zionyx Studios LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from or related to your use of BrightBox. Our total liability for any claim will not exceed the amount you paid (if any) for the current subscription period.
(Some jurisdictions do not allow certain limitations—those limits apply only to the extent permitted by law.)
10) Indemnity
You agree to indemnify and hold harmless Zionyx Studios LLC from claims, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of BrightBox or violation of these Terms.
11) Third-Party Services
BrightBox may rely on third-party processors (e.g., for speech or response generation). Those providers process limited data solely to deliver the requested features under contractual safeguards. Purchases are processed by Apple.
12) Termination
These Terms remain in effect until terminated. You may stop using BrightBox at any time and cancel your subscription via iOS Settings. We may terminate or suspend access for violations of these Terms or where required by law.
13) Governing Law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules, and applicable U.S. federal law. Courts located in Denton County, Texas will have exclusive jurisdiction and venue for disputes arising out of or related to these Terms, unless local law requires otherwise.
